These Terms of Service ("Terms") govern your access to and use of the Rally iOS app, the joinrally.app website, and related services (collectively, the "Service") operated by Rally ("Rally," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
You must be at least 13 years old to use Rally. If you are under 18, you may use Rally only with permission from a parent or legal guardian who accepts these Terms on your behalf. You must provide accurate account information and keep your credentials secure.
Rally helps runners discover group runs, RSVP and check in, connect with other runners, and participate in community and messaging features. Rally may add, change, or remove features at any time.
During free launch periods, core features may be available without payment. Founding Member status, subscriptions, and paid features may be offered in the future under separate terms shown in the app at the time of purchase.
You may submit content such as profile information, messages, reports, and other materials ("User Content"). You retain ownership of your User Content, but you grant Rally a non-exclusive, worldwide, royalty-free license to host, store, display, and use User Content as needed to operate, improve, and secure the Service.

Rally helps people find and coordinate runs, but Rally does not organize, supervise, or control in-person events. You are solely responsible for your decisions to attend runs, meet other users, and participate in offline activities. Use common sense, meet in public places when possible, and stop using the Service to contact anyone who has blocked you or asked not to be contacted.
You may report users or messages and block other users in the app. We may review reports, restrict features, remove content, or terminate accounts at our discretion. We are not obligated to monitor all User Content and do not guarantee that all objectionable content will be removed.
If paid memberships are offered, pricing, billing, renewal, cancellation, and refund terms will be presented in the app and through the applicable payment provider, such as Apple In-App Purchase. Purchases made through Apple are subject to Apple's terms and payment policies.
Founding Member status, when offered, is a recognition benefit assigned according to in-app and server-side eligibility rules. It does not create a separate contractual entitlement beyond what Rally expressly provides in the app.
Rally and its branding, design, software, and content are owned by Rally or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service except as allowed by these Terms or applicable law.
The Service may include links to third-party websites, clubs, or services. Rally is not responsible for third-party content, policies, or practices.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, RALLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. RALLY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RALLY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. RALLY'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNT YOU PAID RALLY IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
You agree to defend, indemnify, and hold harmless Rally from claims, damages, losses, and expenses arising out of your use of the Service, your User Content, your offline interactions with other users, or your violation of these Terms.
You may stop using Rally at any time. We may suspend or terminate your access if you violate these Terms, create safety risk, or if we discontinue the Service. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, and indemnity.
We may update these Terms from time to time. If we make material changes, we may provide notice in the app or on this page. Continued use after the effective date of updated Terms constitutes acceptance.
These Terms are governed by the laws of the Commonwealth of Massachusetts, excluding conflict of law rules, except where prohibited by applicable law.
